“HHonors Points Giveaway” (the “Promotion”)
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA WHO ARE AT LEAST 18 YEARS OF AGE AT THE TIME OF ENTRY. Employees (and their immediate families and those living in their same households, whether or not related) of Hilton HHonors Worldwide, L.L.C. (“Sponsor”), Daniel J. Edelman, Inc. and their subsidiaries, affiliates, parent companies, retail locations, suppliers, distributors, advertising, promotion or any other agencies or entities involved with this Promotion, and the employees, shareholders, directors, officers, members and agents of each (collectively, “Released Parties”) or members of their immediate families (biological, step, or in-law), including parents, grandparents, children, siblings or spouses of any of the foregoing (regardless of where they live) or households of any of the above, whether related or not, are NOT eligible to participate. Void where prohibited. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Promotion. Promotion is subject to all applicable federal, state and local laws. Participation requires that you have a Twitter account and follow Hilton HHonors® on Twitter.com at www.twitter.com/HiltonHHonors (“@HiltonHHonors”). While membership in the Hilton HHonors program is not a requirement for entry, potential winners will need to enroll in the Hilton HHonors program in order to receive a prize. There is no charge to either sign up for Twitter, follow @HiltonHHonors or become a member of the HiltonHHonors program. Twitter is not a sponsor of or otherwise affiliated with this Promotion. TO ENTER: The Promotion begins 12:00 p.m. Eastern Time (ET) on November 17, 2011 thru 9:00 p.m. (ET) November 21st, 2011 (“Promotion Period”). Seven (7) winners will be chosen at random between 8:00 p.m (ET) and 9:00 p.m on November 21, 2011 (“Twitter Party”), @ComplicatedMama will post a tweet announcing each winner. Entrants must: (1) RSVP for party via TwitVite at http://twtvite.com/HiltonHHonorsHoliday (2) Tweet with the hashtag #HHtravel during the Twitter Party between the hours of 8pm ET and 9pm ET (Any entries past 9pm ET will not be eligible). All winners will be chosen in random drawings.
Limit one (1) Entry per person/e-mail address/Twitter account each day during the Promotion Period. If multiple Entries are received in a given day during the Promotion Period, only the first entry received will be eligible. Additional Entries are void. Incomplete, illegible and/or multiple entries are void. All entries submitted become the sole property of the Sponsor and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Sponsor reserves the right to void any or all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method. Entries will be deemed made by the authorized account holder of the applicable Twitter account. Sponsor may, in its sole discretion, require any potential winner to provide Sponsor with verification information. Sponsor’s HHonors staff member may, in its sole discretion determine that an Entry does not qualify.
ENTRY GUIDELINES: Entrant must RSVP via Twitvite, http://twtvite.com/HiltonHHonorsHoliday, participate in the Twitter Party between 8:00 p.m (ET) and 9:00 p.m on November 21, 2011 and use the “#HHtravel” hashtag, and follow @HiltonHHonors and @ComplicatedMama. Entries may not be obscene or indecent; cannot be sexually explicit or suggestive, profane or pornographic, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; cannot be offensive, endorse any form of hate or hate group; cannot defame, misrepresent or contain disparaging remarks about Sponsor or its products or services, or other people, products or companies; cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; may not invade privacy or other rights of any person, firm or entity; may not in any other way violate any applicable federal, state or local laws or regulations or the Twitter.com Terms of Service; may not contain any reference to any third party trademarks, names or third party logos or any copyrighted components; and cannot contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses. Entries not in compliance with the Entry Guidelines, as determined in the sole discretion of Sponsor, may be disqualified without notice.
WINNERS/PRIZE/NOTIFICATION: Monday, November 21, 2011 between 8pm ET and 9pm (ET), five (5) winners will each receive ten thousand (10,000) Hilton HHonors points, Approximate Retail Value (“ARV”) of $100.00USD, one (1) winner will receive twenty thousand (20,000) Hilton HHonors points, Approximate Retail Value (“ARV”) of $200.00USD and one (1) Grand Prize winner will receive one (1) five hundred ($500.00) Hilton HHonors gift card, Approximate Retail Value (“ARV”) of $500.00USD. Total ARV of all prizes is $1,100.00USD No substitution or transfer of prizes, except that Sponsor reserves the right to substitute a prize with another prize of equal or greater value if advertised prize or any component thereof is not available.
Potential winners will be notified between 8pm (ET) and 9pm (ET) on November 21, 2011 via direct communications on the Twitter site, and will be required sign up for a Hilton HHonors account for prize transfer. Please allow 4-8 weeks after winner verification for receipt of prize. Potential winner may be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release within 14 days of the date on the prize notification or the prize may be forfeited. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to the minor’s parent or legal guardian, who must sign and return all required documents. If a potential winner cannot be contacted, fails to sign and return the required Affidavit of Eligibility, Liability and Publicity Release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize. Sponsor is not responsible for any change in Twitter account information, email, mailing address and/or telephone number of entrants. All taxes on prizes are the sole responsibility of the winner. Unclaimed prizes will not be awarded. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded.
Sponsor makes no offer of any warranty or guarantee, either expressed or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Promotion. No substitution or transfer of prizes, except that Sponsor reserves the right to substitute a prize with another prize of equal or greater value if advertised prize or any component thereof is not available. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion. Prize consists only of the items listed, is non-transferable, with no cash redemption or substitution except at Sponsor’s sole discretion. Winner is responsible for all applicable federal, state and local income taxes. Winner is responsible for any expenses associated with prize acceptance and use not expressly specified herein as being provided. All prize details are at Sponsor’s sole discretion.
ELIGIBILITY: This Promotion is only open to legal residents of the 50 United States and the District of Columbia who are 18 years or older at the time of entry. Employees of Hilton Worldwide, its subsidiaries, affiliates, parent companies, retail locations, suppliers, distributors, advertising, promotion or any other agencies or entities involved with this Promotion, and the employees, shareholders, directors, officers, members and agents of each (collectively, “Released Parties”) or members of their immediate families (biological, step, or in-law), including parents, grandparents, children, siblings or spouses of any of the foregoing (regardless of where they live) or households of any of the above, whether related or not, are NOT eligible to participate. Void where prohibited.
GENERAL CONDITIONS: Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, or garbled stay data, emails, online or mailed entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of completed stays or entries, the announcement of the prize or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Promotion or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Promotion or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion at any time and for any reason arising from circumstances beyond its reasonable control, including, but not limited to, should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries.
LIMITATIONS OF LIABILITY: Neither the Sponsor Daniel J. Edelman, Inc., nor Hilton HHonors, or any of their respective parents, affiliates, subsidiaries, franchisees or advertising and promotion agencies or prize suppliers or any of their respective officers, directors, employees, representatives and agents will have any liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize (including without limitation any travel or activity related thereto) or participation in this Promotion. In no event will more than the stated number of prizes be awarded.
GRANT OF PUBLICITY: Winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes relating to this Promotion without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. Submission of contact information in connection with this Promotion (whether or not required), including mailing address, phone number, and email address during entry constitutes permission for Sponsor to add entrant to Sponsor’s customer database and to contact entrant in the future for promotional and other reasons. You may opt-out of receiving such communications as set forth in Sponsor’s Privacy Policy, located at http://www1.hilton.com/en_US/hi/customersupport/privacy-policy.do.
GOVERNING LAW/JURISDICTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants or Sponsor in connection with the Promotion shall be governed by and construed in accordance with the internal laws of the state of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state laws. Claims may not be resolved through any form of class action. Venue for all suits will be in federal or state courts located in Fairfax County, Virginia.
SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
